D66 Arnhem: APV-wijziging niet rechtvaardig
*“Het lokale recht moeten bovenal rechtvaardig zijn.” Met deze uitspraak
stelde D66 raadslid Mattijs Loor enkele misstanden in de voorgestelde
wijziging van de Algemene Plaatselijke Verordening (APV) aan de kaak.
Bij de behandeling van de APV-wijziging op maandag 26 september diende hij twee
amendementen en een motie in om dit te repareren. Omdat de verbeteringen
van D66 het niet allemaal haalden, stemde de fractie tegen de wijziging van
de APV.

‘Slecht levensgedrag’
Eerste struikelblok is de bepaling dat een ondernemer zijn vergunning kan
verliezen op basis van ‘slecht levensgedrag’; een uiterst vaag begrip.
“Zonder tussenkomst van een rechter wordt dan een ondernemer én zijn
werknemers hun levensonderhoud ontnomen. Dat gaat in tegen de principes van
onze rechtstaat”, stelt Loor. Het amendement om dit in te perken is
maandagavond aangenomen.
Bestuurlijke boete
Een ander punt zit wat D66 betreft in de uitwerking van de Bestuurlijke
Boete. De boete die voortaan door de gemeente wordt geïnd in plaats van
door het Centraal Justitieel Incassobureau. Hierbij zouden boetes voor
bedrijven en instellingen tien keer zo hoog zijn als voor personen. Dit
leidt tot willekeur in de handhaving wanneer onduidelijk is of een
natuurlijke persoon of een rechtspersoon wordt beboet. Op vragen van D66
bleef onduidelijk hoe dit in de praktijk uit zou pakken. Raadslid Mattijs
Loor: “Wethouder Ritsema vindt dat eerst bezwaar gemaakt moet worden tegen
een te hoge boete, in plaats van dat direct een redelijke sanctie wordt
opgelegd. Voor ons is dat onbegrijpelijk.”
De vervuiler betaalt
Daarnaast ontbreekt de noodzaak voor de vertienvoudiging. Het doel is dat
overtredingen voor bedrijven niet lonend zouden zijn. Met het verhalen van
de herstel- of opruimkosten of vervolging onder de Wet Economische Delicten
heeft de gemeente voldoende andere middelen om te zorgen dat de vervuiler
betaalt. Loor: “Wie gemeentelijke eigendommen beschadigt of rommel
achterlaat betaalt voor het herstel. Dat lijkt ons de juiste maatstaf.” Een
motie hierover van D66 werd met brede steun aangenomen.
Omdat voor het schrappen van de vertienvoudiging van de Bestuurlijke Boete
geen meerderheid was, stemde D66 tegen de APV-wijziging. Loor: “Het risico
onterecht onderscheid te maken bij de hoogte van boetes zonder dat hier een
goede reden voor is, maakt voor ons deze boeteregeling onacceptabel.”
